Terms of use

GrowingTale is an online service that lets you make films from photos using image, video and AI technology.
It may include uploading photos, making growing-up films and memories films, generating transitions and motion, arranging the order of photos, creating openings, adding music and closing notes, and watching, saving and downloading the film.
Features may change, be added or removed from time to time.

Some features require signing in with an email address, Google or another method we may offer.
You are responsible for the accuracy of the details you give and for keeping access to the account and its email address.
Do not pass account access to others in a way that could allow unauthorized use.

Photos, videos, texts, audio files and other content you upload remain yours or the property of their rights holders.
By uploading you confirm you may use the content and that its use in GrowingTale does not infringe anyone's rights, including copyright, privacy, publicity or other rights.

If another person appears in a photo, make sure you have appropriate permission to use it for the film.
For photos of minors, you must be a parent, guardian or person lawfully authorized to use them for this purpose.
If we receive a credible claim of unauthorized use, we may review it and limit access to or remove the content as circumstances and law require.

The service may not be used to create, upload or distribute illegal content or content that infringes others' rights.
Among other things, do not use the service to:

• create sexual or intimate content without consent;
• create sexual content involving minors;
• impersonate someone deceptively, defraud, or create a false impression that may cause harm;
• defame, threaten, harass or harm another person;
• promote hatred, terrorism or unlawful violence;
• infringe copyright, privacy or other intellectual-property rights;
• attempt to bypass safety, security or service limits;
• use the service in a way that may harm systems, other users or GrowingTale's proper operation.

We may block a creation, remove content, limit use or suspend an account for a breach of these terms or where needed to protect users, third parties or the service.

Some features rely on AI models and external technology providers.
To make the film, the photos or other information you upload may be processed by those providers, per our privacy policy and the arrangements with them.
AI results are not always predictable or accurate; appearance, facial features, motion, background or other details may change.
In some cases we let you make alternatives, swap photos or make adjustments, but we do not promise every photo can be processed or that every result matches the original.

The video models we use may refuse certain photos for technical or safety reasons.
In that case the service may let you crop, swap or remove the photo.
We cannot guarantee that every uploaded photo can be used in the film.

If the service lets you upload your own music or audio, you are responsible for holding the rights and permissions needed.
Buying a song or holding a music subscription does not necessarily grant the right to include it in a film, publish or distribute it.
We may remove or limit audio content on a credible infringement claim or where its use may violate the law or third-party rights.
Music we provide is subject to its own license terms.

The initial preview is offered free, per the terms shown on the site.
Buying the full film is a one-time purchase, not a subscription, unless expressly stated otherwise at purchase.
The price depends on, among other things, the number of photos and the options chosen, and is shown before payment.
Prices may change over time, but a change does not affect a completed transaction.
Payment is handled by an external payment processor. Full card details are not stored by GrowingTale where processing happens directly with the processor.

The purchase includes the film and the options shown at payment.
Depending on the package and features available at the time, these may include an opening, music, a closing note, HD download and a version without a watermark.
The service may include a quota of additional creations or changes at no cost; the quota and the actions that use it are shown in the interface.
Services or creations beyond the included quota may carry an extra charge, shown before the action is confirmed.

The service may allow changing photos, making alternative transitions, changing the order, opening, music or closing note.
Some changes require regenerating parts of the video and may be subject to the quota or an extra charge.
Wherever an action carries a charge, the price is shown before it is confirmed.
We do not promise every change is possible or that a regenerated result matches the previous version.

GrowingTale's refund policy is published on the site and forms part of these terms.
Where we offer a commercial 30-day refund commitment, it is in addition to the consumer's non-waivable statutory rights.
A refund request is made through the contact details on the site, with the details needed to locate the transaction.
We may decline requests that appear to abuse the refund policy, subject to law.
Nothing in these terms limits a consumer's statutory right to cancellation, a refund or another remedy.

We take no ownership of the photos and original content you upload.
Subject to third-party rights and these terms, you may use the film made for you for personal purposes, including download, sharing and private screening.
You grant GrowingTale a limited, non-exclusive license to use and process the content you uploaded only as needed to run the service, make the film, store it, provide support and secure the service, per the privacy policy.

How personal information and uploaded content are handled is set out in GrowingTale's privacy policy.
Photos and content are not shown publicly unless the user chooses to share them through a feature made for that.
Retention and deletion periods for photos, films and other information are set out in the privacy policy.

We work to keep the service available and working, but do not promise uninterrupted or fault-free operation.
Outages, delays, technical faults or third-party unavailability may occur.
Creation times shown on the site are estimates unless expressly stated otherwise.

The service and its results are provided subject to the limits of current technology.
To the maximum extent permitted by law, GrowingTale is not liable for indirect, consequential or special damage arising from use of, or inability to use, the service.
Nothing here limits liability that cannot be limited or excluded by law.

The site, the GrowingTale brand, design, software, texts, graphics and other components of the service that are not user content are protected by intellectual-property rights.
They may not be copied, distributed, reverse-engineered, sold or used commercially without appropriate permission, except as permitted by law.

We may limit or suspend access to the service on reasonable suspicion of a breach of these terms, unlawful use, an attempt to harm the service, or risk to users or third parties.
Where possible and appropriate we act proportionately.

We may update these terms from time to time.
The date of the last update is shown at the top of the page. For a material change we will give notice as circumstances and law require.
Changes do not apply retroactively where the law does not allow it.

These terms are governed by the laws of the State of Israel.
Any dispute will be heard by the court that has jurisdiction under the law.

If you believe content used through GrowingTale infringes your copyright, privacy or another right, you may contact us with:

• a description of the content or right you say was infringed;
• information that lets us locate the content;
• a short explanation of your right and the reason for the claim.

We review credible claims and take appropriate steps as circumstances and law require.
